The U.S. continues to prioritize certain groups for refugee admission, including those facing severe persecution or fleeing humanitarian crises, such as Afghan nationals or individuals escaping conflict zones. However, being part of a priority group does not guarantee approval, as the process remains highly selective and requires extensive documentation and evidence to establish eligibility.

Eligibility for Refugee Status

To qualify for refugee status in the U.S., applicants must meet specific criteria outlined by the U.S. government. • An applicant must meet the legal definition of a refugee under U.S. law, including a well-founded fear of persecution based on race, religion, nationality, political affiliation, or membership in a social group.
• The applicant must be referred for resettlement by a recognized agency, such as the UNHCR, or qualify under specific U.S. priority categories.
• They must not have been firmly resettled in another country prior to seeking refugee status in the United States.
• They must be admissible under U.S. immigration law.

The U.S. refugee system uses a priority system to process applications.

• Priority 1: Individuals referred by the UNHCR, U.S. Embassies, or approved organizations for resettlement.
• Priority 2: Groups identified as being of special humanitarian concern, such as nationals of certain countries experiencing significant political or social instability.
• Priority 3: Eligible family members of individuals previously granted refugee or asylee status in the U.S.

The number of refugee admissions is capped annually by the Presidential Determination, and the process can involve detailed documentation to support the claim of eligibility and need.
