Refugee status is granted to individuals outside the United States who have fled their home country due to persecution or a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group. The U.S. Refugee Admissions Program (USRAP) manages eligibility and requires referrals from entities such as the United Nations High Commissioner for Refugees (UNHCR), U.S. embassies, or designated non-governmental organizations.

Once approved as a refugee, applicants must complete Form I-590, participate in a thorough interview, undergo medical examinations, and pass national security screenings. Approved refugees become eligible for resettlement assistance and certain benefits. However, recent policy adjustments have reduced eligibility for cash and medical assistance from 12 months to 4 months, reflecting resource constraints and underscoring the importance of expert legal guidance.
